User Acknowledgment
Version 3
ACKNOWLEDGMENT OF RESPONSIBILITY AND LIMITATION OF LIABILITY
This Acknowledgment is made by the undersigned user (“User”) in connection with the use of ClaimCadence, the drafting assistant software provided by 25 Fathoms, LLC (“Company”).
1. Nature of the Software and Output
User acknowledges that the software is an automated technological tool and does not provide legal advice, technical verification, or statutory compliance mapping. No attorney-client relationship is created by the use of the software. Any generated text, citations, or proposed claim amendments are preliminary, automated drafts and are not meant to be filed without the User’s thorough review.
2. “As-Is” Warranty Disclaimer
THE SOFTWARE AND ALL GENERATED OUTPUT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY MAKES NO WARRANTY THAT THE OUTPUT WILL BE ACCURATE, COMPLETE, ERROR-FREE, OR FREE FROM ARTIFICIAL INTELLIGENCE “HALLUCINATIONS.”
3. Sole Responsibility for Submissions
User retains exclusive control over, and assumes all liability for, the accuracy, truthfulness, and regulatory compliance of any text submitted to the U.S. Patent and Trademark Office (USPTO). The final decision to adopt, modify, or file any output rests solely with the User, who assumes all risk associated with such filings. The software may propose claim scope or embodiments the User did not supply; whether each reflects the named inventors’ own conception is solely the User’s determination.
4. Disclaimer of Liability and Indemnification
To the extent permitted by applicable law, including the law of User’s state of residence, Company shall not be liable for any regulatory sanctions, malpractice actions, loss of patent rights, or damages resulting from the User’s reliance on or filing of text generated by the software. To the same extent, User waives any claims against Company arising from errors, omissions, or factual inaccuracies contained in the software’s output.
Furthermore, to the extent permitted by applicable law, including the law of User’s state of residence, User agrees to indemnify, defend, and hold harmless Company from and against any third-party claims, liabilities, losses, or legal fees (including attorney’s fees) arising out of or related to any documents or arguments submitted by User to the USPTO or any other patent authority.
This Acknowledgment is part of the ClaimCadence Terms of Service.
