1. Who Can Use ClaimCadence
You must be 18 or older. The service is for registered patent practitioners, the people they authorize, and inventors who file their own applications without a registered practitioner (“pro se applicants”). Wherever these terms say “practitioner,” that includes a pro se applicant for their own applications. By using it, you represent that you are the practitioner of record for the matters you submit, or authorized by that practitioner, and that you are entitled to submit the materials you send us. If you are a practitioner and you authorize someone else to use the service, you must review that person's work before anything is filed.
2. What ClaimCadence Is
ClaimCadence™ is a drafting and research service provided by 25 Fathoms, LLC. We prepare office action responses and related work product for you, the practitioner. We are your vendor. We are not a law firm.
3. Supervised Work Product; No Unauthorized Practice of Law; No Attorney-Client Relationship
Everything we prepare is supervised work product for you, the practitioner of record. You direct the work, you review it, you sign it, and you file it, and you carry the professional responsibility for it. We do not represent your client. We do not form an attorney-client relationship with your client. We do not contact the USPTO or your client on any matter. We do not engage in the practice of law. Our role is to assist you, the practitioner (or pro se applicant), with drafting and research that you supervise and adopt as your own.
4. Not Legal Advice
Our work product and any communication from us is drafting and research support, not legal advice, and not a substitute for your professional judgment. You are responsible for reviewing every document, verifying every cited authority, and making every filing decision.
5. How Drafts Are Prepared
Our drafts are prepared with the help of artificial-intelligence tools, including models provided by Anthropic, and are checked against our own drafting rules before delivery. ClaimCadence is a non-practitioner assistant working under the supervision of the practitioner who signs. What we deliver is a draft, not meant to be filed without thorough review. You decide whether and how to disclose the use of AI assistance to the USPTO, and the certifications made by signing a paper belong to the practitioner who signs it. Verify every statement of fact, every citation, and every claim amendment before you adopt a draft.
6. No Guarantee of Outcome
We do not guarantee any prosecution result, including allowance, and we make no promise that any argument or amendment will be accepted by the USPTO. Any statement about the strength of a rejection or a response is our honest assessment, not a prediction of outcome.
7. Draft, Not For Filing Until You Adopt It
Every deliverable is provided stamped as a draft and marked not for filing until you adopt it. Nothing we prepare is filed by us or on your behalf. A document becomes a filing only when you, the practitioner, review, sign, and file it.
8. Deadlines and Delivery
You own docketing and every USPTO deadline. We deliver each matter by the date we agree for it. If we deliver late or cannot complete a matter, our only obligation is to refund the fee for that matter.
9. Your Account
You are responsible for your account credentials and for activity under your account. Tell us promptly of any unauthorized use.
10. Your Materials and Your Client's Materials
You retain ownership of the materials you submit, including your client's materials. You grant us a limited license to use those materials solely to prepare and support the work product you request. You represent that you have the authority and any necessary client consent to submit those materials to us for this purpose. Unless you send us more, we work from the public prosecution record. Tell us before you send export-controlled technical data or material under a secrecy order; we may decline it. We process matter materials in the United States.
11. Confidentiality of Matter Materials
We treat your matter materials as confidential. We do not sell them and do not share them with third parties for their own use. We use them only to prepare and support your work product, and we limit internal access to the people doing that work. If we confirm unauthorized access to your matter materials, we will notify you within 72 hours of confirming it. This obligation continues after your use of the service ends. See the Privacy Policy for how we handle data.
12. Conflicts
We do not knowingly prepare work for opposing sides of a contested matter. Tell us about any adverse party you know of when you send a matter. We may decline any matter, and if we learn of a conflict after we start, we will tell you and may stop work and refund the fee for that matter.
13. Acceptable Use
Do not use the service to submit materials you are not authorized to submit, to violate any law or professional rule, to infringe others' rights, or to interfere with the operation or security of the service.
14. Fees and Refunds
Free Rejection Reads are provided at no charge. Fees for paid work are quoted per matter before work begins, or drawn from prepaid credits, as stated on the order or the pricing page. Prepaid credits are valid for 12 months from purchase. Unused credits may be refunded on request within 30 days of purchase; after that they remain usable for the rest of the 12 months but are not refundable. Used credits and completed matters are not refundable, except as stated in Section 8. Fees are exclusive of taxes unless stated.
Free work product. A free Rejection Read, and any free draft reply we offer with it, is supervised work product for you as the practitioner of record under Sections 3 through 7. It is provided at no charge and as is, without any warranty. You decide whether to adopt any of it, and none of it may be filed until you have reviewed it and adopted it as your own. A free draft can be downloaded for 72 hours from the email telling you it is ready; after that the download ends, and we keep a record copy as described in our Privacy Policy. You may use a free Read and a free draft only for the application it covers. We may decline or limit free work, including one free draft per practitioner.
15. Ownership of Work Product; Our Intellectual Property
Once you have paid for a matter, you own the work product we deliver for it. The site, our methods, rules, templates, tools, and non-client materials are owned by 25 Fathoms, LLC. We may use de-identified lessons from our work to improve our methods, never material that identifies you, your client, or a matter.
16. Feedback
If you send us feedback, you grant us the right to use it without restriction or obligation to you.
17. Third-Party Services
The service relies on third-party providers for hosting, storage, email, payment processing, and AI drafting assistance (Anthropic). Each processes data only to provide its service to us, and our AI provider account is set so your matter materials are not used to train its models. Their services are governed by their own terms.
18. Disclaimers
The service is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You remain responsible for the professional review and filing of all work product.
19. Limitation of Liability
To the extent permitted by applicable law, including the law of your state of residence, our total liability for any claim arising out of or relating to the service is limited to the amount you paid us for the work product at issue. The work product at issue is the Rejection Read or draft reply we prepared for one Office Action in one application. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or prosecution outcomes.
20. Indemnification
To the extent permitted by applicable law, including the law of your state of residence, you agree to indemnify and hold harmless 25 Fathoms, LLC from claims arising out of your use of the service, your filings, your professional conduct, or your submission of materials you were not authorized to submit.
21. Suspension and Termination
We may suspend or end your access for violation of these terms or for misuse of the service. You may stop using the service at any time.
22. Governing Law and Disputes
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. To the extent permitted by applicable law, including the law of your state of residence, disputes will be brought in the state or federal courts located in Hamilton County, Ohio, and you consent to that venue.
23. Changes to These Terms
We may update these terms. When we do, we will change the date above and, for material changes, provide additional notice. Continued use after a change means you accept it.
24. Miscellaneous
If any provision is unenforceable, the rest stays in effect. These terms, together with any signed services agreement between us, are the entire agreement between you and us regarding the service; if they conflict, the signed agreement controls. Our failure to enforce a provision is not a waiver.
